Transformative effects of globalisation and law in the Netherlands

There are two aspects to the relation between globalisation and law. On the one hand, globalisation means that law itself is increasingly made, interpreted and applied beyond the state (transnational law, European law, international law, global law). On the other hand, globalisation refers to transboundary social, economic and political processes. The law (national, transnational, European, international and global) seeks to regulate, channel, check and facilitate these processes.

Globalisation raises profound questions from the point of view of the rule of law in national legal orders. It affects the trias politica, legal certainty and effective legal protection. The research programme Transformative effects of globalisation and law in the Netherlands focusses on the relation between globalisation and law from the perspective of the rule of law in the Netherlands.
